Legal Terms of the "Mother's Day Draw" Promotion
First.– ORGANIZING COMPANY, OBJECT, DURATION AND SCOPE
The organization of the promotional draw is promoted by the company Greve Invest SL (hereinafter, “VIDAL & VIDAL”) with its registered office at Calle Bijuters 55, A, 07720 Es Castell (Balearic Islands) with CIF B07839814.
VIDAL & VIDAL organizes, for promotional purposes, the draw "Mother's Day Draw" (hereinafter, the "Promotion") of national scope, to be carried out through the Internet and physical stores, open to participants of legal age.
The Promotion will start on April 17, 2024 at 20:00 (Spanish mainland time) and will end on April 24, 2024 at 23:59 (Spanish mainland time).
Notwithstanding the foregoing, VIDAL & VIDAL reserves the right to modify the Promotion dates at its convenience.
Second.– PARTICIPATION REQUIREMENTS
All those persons (hereinafter, the "Participants") who accept these Legal Terms and meet the following participation rules may participate in the promotion:
Must always be over the age of 18.
The Promotion will be conducted through: Instagram.
To participate:
- Have a valid profile on Instagram.
- Follow VIDAL & VIDAL's profile (@vidaljewelry).
- Mention in the comments of the promotional photo of the draw on VIDAL & VIDAL's profile (@vidaljewelry) two friends, family members or acquaintances who have a valid Instagram profile.
Third.– PRIZES, PROMOTION CONDITIONS AND REDEMPTION METHOD
Specifically, the three winners will be selected by drawing through the EasyPromos app or similar among users who have met the participation requirements. Participants who have not followed all the steps of the dynamic will be automatically eliminated from the draw. Any profile detected as fake or committing fraudulent acts will also be removed from the draw.
Once VIDAL & VIDAL is aware of who the winners are, it will communicate from April 25, 2024 through its official channels and by directly contacting the affected.
The prize of this Promotion specifically includes, for each of the three (3) winners:
One (1) gift voucher valued at one hundred fifty (150) euros, to be redeemed on the official VIDAL & VIDAL website (www.vidal-vidal.com) and a special edition VIDAL & VIDAL jewelry box.
Regarding the conditions of the prize:
- (i) the prize of one hundred fifty (150) euros will be offered in a coupon, redeemable in a single purchase on the official website of VIDAL & VIDAL (www.vidal-vidal.com).
- (ii) the prize will be valid to redeem on the official website of VIDAL & VIDAL (www.vidal-vidal.com) for the next thirty (30) calendar days from the resolution of the draw.
- (iii) in case the full amount of the first coupon is not used, a second coupon with the remaining amount will be offered to complete the one hundred fifty (150) euros. If with the second coupon the total amount of the prize is not reached, the remaining amount will be lost. If the total amount of one hundred fifty (150) euros is exceeded, the reimbursement of the surplus amount is the responsibility of the Winner.
- (iv) The validity of the second coupon will be fifteen (15) days from the date of receipt of said coupon.
- (v) the prizes are non-transferable and cannot be exchanged for cash or any other product.
If the winner could not be located or contacted within seven (7) calendar days following the date of communication from VIDAL & VIDAL, the prize will be awarded to the next in time to meet the participation requirements and it will be understood that the first winner irrevocably waives the prize granted. If the substitute Participant could not be located within a new period of seven (7) calendar days from the communication sent by VIDAL & VIDAL, the prize will remain unawarded.
Any tax burdens that acceptance of the prize may entail for the winner, as well as any other expense arising from the Promotion that is not expressly assumed by VIDAL & VIDAL in these Legal Terms, will be borne by the winner.
Fourth.– LIMITATIONS
The following people, nor their spouses, ancestors, or descendants up to the second degree (inclusive), may not participate in the Promotion:
- (i) employees who work for any of the companies and other legal entities linked to VIDAL & VIDAL,
- (ii) individuals who participate directly or indirectly in the capital of VIDAL & VIDAL,
- (iii) any other individual who has participated directly or indirectly in this Promotion or has been involved directly or indirectly in its preparation or development (agency, suppliers, etc.).
By accepting these Legal Terms, Participants consent that VIDAL & VIDAL exclude or disqualify these participations from the Promotion.
Participations that are made after the end date of the Promotion, as well as those that do not meet the requirements set forth in the second section of these Legal Terms, will be considered null and void. VIDAL & VIDAL reserves the right to exclude from the Promotion those Participants who are suspected or detected to have participated in any fraudulent manner.
If it is evidenced that the winners or substitutes do not meet the requirements set in the Terms, or do not accredit what is requested of them, their participation will be considered null and they will be automatically excluded from the Promotion, losing all rights to the prize awarded under this Promotion.
The prize awarded will not be subject to changes, alterations, or compensations at the request of the winners, and cannot be exchanged for any other product or for money. VIDAL & VIDAL reserves the right, if there is just cause and prior legal communication, to make any change, suspend or extend this Promotion.
A period of fifteen (15) calendar days from the date of the award of the prize is established to make any claim motivated by this Promotion. Once the fifteen (15) calendar days from the date of the award of the prize have elapsed, the formalization and/or management of the prize will proceed.
It is recorded by this document that the Participants do not have to pay, as a result of the proposed draw, any additional amount to VIDAL & VIDAL.
VIDAL & VIDAL reserves, in case of necessary need, the right to substitute the prizes for others of similar characteristics.
Fifth.– EXCLUSION OF LIABILITY.
By way of illustration and not limitation, VIDAL & VIDAL is not responsible for the following circumstances:
The use made by the winner regarding the prize of this Promotion.
Damages of any kind that may be due to the temporary unavailability or continuity of the operation of telecommunications networks.
The services provided by any other entity with which VIDAL & VIDAL collaborates in providing services to the winner, as a consequence of the prizes delivered, as well as those derived from negligent performance in the enjoyment of them.
Cases of force majeure or unforeseeable circumstances that could prevent the realization of the Promotion or the total or partial enjoyment of its prize. In case this Promotion could not be carried out, either due to detected frauds, technical errors, or any other reason that is not under the control of VIDAL & VIDAL and that affects the normal development of the Promotion, VIDAL & VIDAL reserves the right to cancel, modify, or suspend it.
Sixth.– LIMITATIONS ON THE CONTENT OF PHOTOS AND COMMENTS.
Discrimination: In no case may they be made with an intention that intends to discriminate against third parties and that violates the principles of the right to honor, personal and family privacy, one's own image, and the dignity of the person. Any type of discriminatory content is prohibited whether it be for reasons of race, sex, religion, opinion, nationality, disability, or any other personal or social circumstance.
Illegal activities: They may not include content that promotes illegal activities or incorporates obscene or defamatory content.
Self-destructive content: Including content that promotes the use of narcotic substances or could incite eating disorders and self-harm is prohibited.
Violence: It is expressly prohibited to participate with photos and comments that promote violence and/or include without limitation, sexual violence or violence against animals and people.
Degrading content: Photos and comments that are intimidating, threatening, degrading, or in any way promote violence against a specific person or group are not allowed.
Sexual content: It is expressly prohibited to incorporate any type of sexual content.
In the event that it is accredited that any of the Participants of the Promotion incurred in any of the limitations established in this section, VIDAL & VIDAL reserves the right to exclude said Participant from the present Promotion.
VIDAL & VIDAL is not responsible for the damages caused by the content included in the photographs published by the Participants in the Promotion, and that at any given time may hurt the sensitivity of other Participants, therefore VIDAL & VIDAL declines all legal and juridical responsibility for all photographs and descriptions.
Seventh.– PROTECTION OF PERSONAL DATA
VIDAL & VIDAL takes the protection of your privacy and personal data very seriously. Therefore, your personal information is kept securely and treated with the utmost care.
In accordance with the provisions of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of April 27, 2016 relating to the protection of natural persons with regard to the processing of personal data and the free movement of such data and repealing Directive 95/46/EC (hereinafter, “GDPR”) and Organic Law 3/2018, of December 5, on Personal Data Protection and guarantee of digital rights (hereinafter, “LOPDGDD”), each Participant with the acceptance of these Legal Terms consents that the personal data provided for participation in this Promotion be incorporated into a database owned by VIDAL & VIDAL to process the participation of the Participant and to communicate the prize in case they were to win.
VIDAL & VIDAL maintains adequate security in accordance with the GDPR and the LOPDGDD, and has established all the technical means at its disposal to prevent the loss, misuse, alteration, unauthorized access, and theft of the data that Participants provide through the Promotion, without prejudice to inform them that the security measures on the Internet are not impregnable. VIDAL & VIDAL commits to comply with the duty of secrecy and confidentiality regarding the personal data contained in the automated file in accordance with applicable legislation, as well as to confer secure treatment in the transfers that may occur, where appropriate.
The Participant guarantees that the personal data provided are truthful and is responsible for communicating any changes to VIDAL & VIDAL. The Participant will be responsible, in any case, for the truthfulness of the data provided, reserving VIDAL & VIDAL the right to exclude from the Promotion any Participant who has provided false data, without prejudice to taking other actions that may be appropriate in Law. It is recommended to exercise maximum diligence in Data Protection by using security tools, VIDAL & VIDAL cannot be held responsible for unlawful thefts, modifications, or losses of data.
We inform you that you can exercise your rights of Access, Rectification, Deletion, Opposition, limitation, portability, forgetting and not being subject to individual automated decisions, by sending an e-mail to info@vidal-vidal.com.
Eighth.– CHANGES AND ACCEPTANCE
VIDAL & VIDAL reserves the right to modify or extend these promotional bases, as long as it does not harm or undermine the rights of the Participants in the Promotion.
Participation in the Promotion entails the full acceptance of these Legal Terms by the Participants who register in this Promotion, which may be protocolized in a Deed authorized by a Notary and will be available to anyone who wishes to consult them.
Ninth.– APPLICABLE LEGISLATION AND JURISDICTION
These Legal Terms will be interpreted and governed in accordance with Spanish law. The Courts and Tribunals of the city of residence of the Participants will be competent to resolve any claim or controversy that may arise in relation to the validity, interpretation or fulfillment of these bases.
